Terms & Conditions- for retail customers
The following describes the terms and conditions that apply to all retail customers which governs the use of this site eurocycles.com.au. By visiting this website you agree that you accept and agree to the content of these Terms and Conditions. Note Trade Customers are bound by separate Terms and Conditions that were agreed to by the Trade Customer when opening a Trade Account.
These Terms and Conditions are governed and construed in accordance with the laws of New South Wales. Disputes arising in connection with these Terms and Conditions will be subject to the laws of New South Wales.
Communications, Newsletters and Electronic Mail-outs
By signing up as an account holder, or as a ‘guest’ customer, or subscribing to our newsletters, you consent to us contacting you by email to facilitate the processing of your order, updating you on delivery times, and providing you with information regarding new products, specials and other relevant information via newsletters and electronic mail-outs. You can opt out of receiving newsletters and electronic mail-outs at any time, using the instructions provided at the end or footer of the newsletter of electronic mail-out.
Payments may be made on our Eurocycles website using Paypal, Visa, Mastercard or American Express. Eurocycles reserves the right to withhold dispatching goods until funds clear into our account. Eurocycles reserves the right to reject any payment that it considers to be fraudulent.
For overseas purchases, you may be required to pay import duties or taxes when the goods arrive in your country. There may also be additional charges for customs and quarantine clearance of the goods. Eurocycles are in no way responsible for any such additional fees and charges, which are the sole responsibility of the purchaser.
Eurocycles endeavours to meet its stated dispatch times. We will inform you by email if there is any delay in dispatching products to you. Multiple orders may be dispatched and arrive separately.
Whilst we endeavour to dispatch goods in the quoted time frames, we cannot be responsible for delays caused by either the couriers we use or Australia Post. You have the right to cancel any delayed order and receive a full refund.
Returns, Exchanges and Warranty
Eurocycles provides a helpful and flexible Returns Policy that allows for returns under a broad range of circumstances. Please refer to our Returns, Exchanges and Warranty Policy presented in our FAQs and ASK section of our website.
Limitation of Liability
Eurocycles Pty Ltd, its employees or its agents will under no circumstances be liable for incidental or consequential damages or expenses, to the extent permitted under law. Eurocycles Pty Ltd will not accept any liability for any injury, damage, loss or third party claim caused by the misuse or improper use of any product purchased from us. We make no warranty or claim as to the suitability of any of our products will meet your requirements, and you will indemnify Eurocycles Pty Ltd for any instance where products fail to need your particular needs. Our liability to you, to the extent permitted under law, is limited to the repair of goods, cost of replacing the goods or the cost of replacing with similar goods of equivalent value.
Further, Eurocycles Pty Ltd will under no circumstances accept any liability to you for any delay in delivery of products ordered via this store. You have the right to cancel any delayed order and receive a full refund.
